RIPMe lets you record what you want people to know and do when you're no longer around to explain it yourself. These Terms explain the rules that apply when you use RIPMe.

RIPMe lets you record what you want people to know and do when you're no longer around to explain it yourself.

These Terms explain the rules that apply when you use RIPMe.

By creating an account or using RIPMe, you agree to these Terms.

1About RIPMe

RIPMe provides a digital service that allows users to record information, preferences, wishes, instructions, memories and other content and nominate trusted people (“Protectors”) who may receive selected information after the user's death and successful completion of RIPMe's verification process.

“RIPMe”, “we”, “our” and “us” refers to the entity operating RIPMe.

“You” and “your” refers to the person creating or using a RIPMe account.

2RIPMe is not a will

This one's important.

RIPMe is not a will and is not a substitute for a legally valid will.

Information recorded in RIPMe may help your family, friends, Protectors and executors understand what you wanted, but recording something in RIPMe does not necessarily make it legally binding.

If something needs to be legally enforceable, it should be included in the appropriate legal document.

3RIPMe doesn't provide professional advice

RIPMe does not provide legal, financial, medical, tax or estate-planning advice.

RIPMe should not be used as a replacement for documents such as a:

  • will;
  • enduring power of attorney;
  • advance health directive;
  • superannuation death-benefit nomination;
  • life insurance nomination; or
  • other legally required estate-planning document.

RIPMe helps tell people what you wanted. It doesn't replace the documents that make certain decisions legally effective.

4Your account

You are responsible for keeping your account information accurate and maintaining the security of your account.

Please tell us promptly at info@ripme.co if you believe someone has gained unauthorised access to it.

5Your information

You control the information you add to RIPMe and are responsible for ensuring, to the best of your knowledge, that it is accurate and that you have the right to provide or upload it.

You must not knowingly use RIPMe to provide fraudulent or unlawful material, impersonate someone, harass another person, infringe another person's rights or interfere with RIPMe's security or operation.

6Passwords and security credentials

Unless RIPMe specifically provides a feature designed for securely storing a particular type of credential, do not enter passwords, PINs, complete credit card details, cryptocurrency private keys or similar security credentials into RIPMe.

If we ask about access to an account, tell your Protectors where the appropriate credentials can be found rather than giving RIPMe the credential itself.

7Protectors

Protectors are an essential part of RIPMe.

You must nominate at least two Protectors.

We recommend three.

You may nominate more, but remember that every Protector you nominate must agree that you have passed away before RIPMe will release your information.

When you nominate someone, RIPMe may contact them and invite them to accept the role.

You may assign different categories of information to different Protectors and can change those assignments while your account and subscription are active.

Being a Protector does not give someone immediate access to your answers.

8Protectors are not executors

Being nominated as a Protector does not appoint someone as:

  • executor of your estate;
  • your attorney;
  • your legal personal representative; or
  • any other legally appointed decision-maker.

A Protector's authority within RIPMe is limited to the functionality RIPMe provides.

9Verification of your passing

RIPMe will not release your answers simply because one person tells us you have died.

For RIPMe's standard verification and release process to be completed:

  • your RIPMe subscription must be active;
  • the required verification process must be initiated;
  • RIPMe will make the required attempts to contact you; and
  • every nominated Protector must confirm that you have passed away.

All means all.

Two Protectors? Both must agree.

Three Protectors? All three must agree.

If you've nominated more, every one of them must agree.

RIPMe does not operate on majority rule.

If one Protector does not confirm your passing, your answers will not be released through the standard Protector process.

10Choosing your Protectors

You are responsible for choosing Protectors you trust and keeping their details current.

Two is the minimum. We recommend three.

You can have more, but more isn't necessarily better. Every additional Protector is another person who must participate in the verification process.

Choose people you trust, who know you and who are likely to be contactable when they're needed.

11Your wishes

RIPMe communicates the information and preferences you recorded.

We cannot guarantee another person will follow them.

Your executor, family, funeral provider, medical professional, financial institution or another person may also have legal rights or obligations that take priority over something recorded in RIPMe.

RIPMe gives them your answers.

We can't make Uncle Steve actually play the playlist.

12Your content

You retain ownership of the content you create or upload.

You give RIPMe a limited licence to host, store, process, copy, display and transmit that content where reasonably necessary to operate RIPMe and provide the services you request.

RIPMe does not become the owner of your photos, letters, stories or answers simply because you store them with us.

13Subscriptions

RIPMe is a subscription service.

Subscriptions purchased through the mobile app are processed through the Apple App Store or Google Play.

Billing, renewal and payment arrangements may also be subject to the applicable app store's terms.

Unless otherwise stated at purchase, subscriptions may automatically renew until cancelled.

14Your subscription is your protection

An active subscription is required for RIPMe's Protector verification and information-release service.

If your subscription expires, is cancelled or otherwise becomes inactive:

  • your Protector coverage stops;
  • your Protectors can no longer declare or confirm your passing through RIPMe;
  • RIPMe's verification process cannot be completed; and
  • your answers cannot be released through the Protector process.

Your answers may remain stored during our 12-month retention period, but storage is not protection.

15Cancelling your subscription

Subscriptions purchased through Apple or Google generally need to be managed or cancelled through the relevant app store.

Deleting the RIPMe app does not necessarily cancel your subscription.

Cancelling your subscription does not immediately delete your answers.

We retain your answers and associated account information for up to 12 months after your subscription becomes inactive.

During those 12 months you may restart your subscription without losing your stored answers.

Once successfully reactivated, your RIPMe functionality and Protector coverage can resume.

If you do not reactivate within 12 months, your stored answers and associated account content may be permanently deleted.

16Cancellation versus account deletion

Cancelling your subscription and deleting your RIPMe account are different actions.

Cancellation stops your active RIPMe protection and starts the 12-month retention period.

Account deletion asks us to delete your account and associated information rather than retain it for reactivation.

17Refunds

Refunds for subscriptions purchased through Apple or Google are generally handled according to the applicable app store's policies.

Nothing in these Terms excludes rights you have under the Australian Consumer Law or any other rights that cannot lawfully be excluded.

18Availability

We will take reasonable steps to keep RIPMe available and working properly.

There may occasionally be outages, maintenance, bugs or interruptions caused by third-party services or events outside our reasonable control.

We may update or change RIPMe features over time.

Where a change materially affects paid functionality, we will provide reasonable notice where practicable.

19Third-party services

RIPMe relies on third-party services including Amazon Web Services, MongoDB, Google Firebase, Salesforce, Apple and Google.

Use of some third-party services may also be subject to their own terms and privacy policies.

20Privacy

Our Privacy Policy explains how we collect, use, store, protect and disclose personal information.

You should read it before creating a RIPMe account.

21Suspension and termination

We may suspend or terminate an account where reasonably necessary, including where we reasonably believe there is serious or repeated breach of these Terms, fraud, unlawful activity or a material security risk.

Where appropriate and reasonably practicable, we will give you an opportunity to address the issue first.

22Our responsibility to you

We will provide RIPMe with due care and skill and in accordance with rights and guarantees applying under Australian law.

Nothing in these Terms excludes, restricts or modifies rights or consumer guarantees that cannot legally be excluded, including under the Australian Consumer Law.

To the extent permitted by law, RIPMe is not responsible for loss caused by circumstances outside our reasonable control or by inaccurate information provided by a user or Protector, a user's failure to keep their information current, another person's failure to follow a user's wishes or failure of a third-party service outside our reasonable control.

23Changes to these Terms

We may update these Terms as RIPMe, our technology, subscription model or legal obligations change.

If a change materially affects your rights or obligations, we will provide reasonable notice where practicable.

The date at the top shows the latest version.

24Australian law

These Terms are governed by the laws applicable in Queensland, Australia.

Nothing in this section limits any rights you may have under applicable Australian consumer law.
